Saving Money For Private SCMs
The City recommends the owner/responsible party of privately owned and maintained stormwater control measures (SCM’s), collect and retain funds for maintenance, repair, replacement, and reconstruction costs of their SCM’s. The City recommends retaining funds in the amount of ten percent (10%) of the SCM’s original cost of construction. Staff recommends those funds be held in a separate account used solely for the purposes of maintaining, repairing, replacing, and reconstructing the owner’s/responsible party’s SCM’s.
The City recommends that these funds be collected/saved by the owner/responsible party in the first five years, beginning when the as-builts for stormwater control project are accepted by Stormwater Staff.
Note: These recommendations are based on G.S. 160D-925, which have not currently been adopted by the City as requirements for the owners of privately owned and maintained SCM’s.
Refund Program for SCM Maintenance
Per HB488, Session Law 2023-108 the City is now making previously collected funds available to SCM Owners for reimbursement.
If you have a privately owned and maintained SCM that was a part of a project approved before November 2, 2023, the owner/responsible party for the SCM may have stormwater maintenance funds available for reimbursement. The purpose of these reimbursements is to reimburse the SCM owner for necessary maintenance, repair, replacement, and reconstruction costs on their devices.
For requests on reimbursement funds available for your SCM, please email reimbursementscm@raleighnc.gov with the N-file # related to your SCM.
For projects approved after November 2, 2023, maintenance funds are not available for reimbursement. Per G.S. 160D-925 the City cannot require an owner of a privately owned and maintained stormwater control project to make payments to the City for the purpose of ensuring assets are available for maintenance, repair, replacement, and reconstruction costs of the owner's SCM.
Refund Process
To request a reimbursement of available SCM Maintenance Account Funds, the owner/responsible party must provide the required documentation at the time of their next SCM Annual Inspection Submittal. This documentation includes:
- A completed Reimbursement Request Form
- Expense Proof for necessary inspection, maintenance, repair, replacement, and reconstruction costs for the owner's SCM’s, that has occurred within the last compliance year.
This documentation should be included as a PDF attachment with the site’s normal Annual Inspection Submittal to scminspections@raleighnc.gov.
