Housing Appeals Board

Public Participation

All meetings shall be open to the general public. The order of business at regular meetings shall be as follows:

  • roll call
  • reading of minutes from the previous meeting
  • hearing of cases; (d) reports of committees
  • unfinished business
  • new business
  • consideration and determination of cases heard previously

The consideration and determination of cases, being in the nature of a judicial proceeding, shall be subject to the requirements of the North Carolina Open Meetings Law.

Anyone that wishes to appeal their Minimum Housing case to the Housing Appeals Board must submit their formal appeal in writing to the Inspections Division no later than ten (10) days from the date of the orders for correction. The appeal must specify the grounds upon which the appeal is being based.


The Housing Appeals Board is made available to any party that wishes to appeal having been charged with Minimum Housing violations. The Housing Appeals Board is given the responsibility of resolving whether those Minimum Housing violations found against a property by an inspector with the Housing & Neighborhoods Department Code Enforcement Division are warranted.

It is the policy of the Housing Appeals Board to conduct an on-site inspection before a decision is finalized. The on-site inspection shall be the day of the hearing and a majority vote of the Board may reschedule the on-site inspection.

Established by Ordinance No. (1969) 902: Four (4) members appointed by Council and one (1) by Wake County. This was enlarged to seven (7) members appointed by Ordinance No. (1983) 117 TC 183.
